Spiel – Terms & Conditions

"Spiel," "we," "our," and "us" refer to Alumco FZ-LLC.

You must be at least 16 years old, or the minimum age of digital consent in your jurisdiction, to use the Services.

By using the Services, you represent that you meet this requirement.

You must provide accurate account information and maintain the security of your credentials. You are responsible for all activity that occurs under your account.

We may suspend, restrict, or terminate access at our discretion for violations of these Terms, misuse of the platform, or harmful behavior.

Spiel may offer:

• subscription plans
• usage-based or credit-based billing
• hybrid pricing models

All purchases are final, and Spiel does not offer refunds, except where required by law.

You authorize Spiel (or its payment partners such as Stripe) to charge all applicable fees to your chosen payment method.

We may change pricing with reasonable notice.

"User Content" includes:

• images
• videos
• audio
• scripts
• avatars (including face scans)
• voice samples
• metadata
• any materials you upload or generate

5.1 You Are Responsible for Your Content

By uploading or generating content, you confirm that:

• you own or have all necessary rights, permissions, and consents
• any individuals depicted (voice or likeness) have given valid consent
• your use complies with all applicable laws

Spiel does not verify consent or ownership and is not liable for unauthorized or illegal content uploaded by users.

5.2 Prohibited Content

You may not use the Services to create, upload, or distribute:

• illegal content
• defamatory or harmful content
• non-consensual content
• sexual or pornographic content (NSFW)
• content involving minors
• attempts to impersonate individuals without authorization
• content that violates intellectual property rights

We may remove, disable, or report such content at our discretion.

6.1 License for Service Operation

You grant Spiel a worldwide, non-exclusive, revocable license to:

• host
• process
• store
• transmit
• modify
• display

your User Content solely for operating, maintaining, and improving the Services.

6.2 Avatars, Face Scans & Voice Samples

To generate avatars, voice models, and outputs, you grant Spiel permission to:

• process your likeness, face scans, and voice samples
• store them securely
• use them internally to improve system performance, quality, safety, and reliability

Spiel will not:

• use your likeness/voice for marketing
• make it public
• sell, license, or distribute it

without your explicit consent.

6.3 AI Model Improvement (Default Opt-In)

Unless you opt out, Spiel may use your uploaded content to:

• improve model accuracy
• enhance system performance
• develop new features
• train internal safety and quality systems

We will provide an opt-out mechanism for users who do not wish to allow this.

You retain ownership of all outputs generated for you through the Services, to the extent permitted by law.

Spiel does not claim ownership over your generated content.

You are solely responsible for how you use generated outputs.

Spiel makes no guarantees that outputs do not resemble third-party content or infringe rights; generative AI systems may produce similar or derivative-looking results.

Spiel uses third-party service providers ("Subprocessors") for hosting, compute, rendering, storage, analytics, and operational infrastructure.

These may include global or regional providers (including the US and EU).

Subprocessors may access your data only to perform services on our behalf and are bound by confidentiality and security obligations.

Spiel is not responsible for the actions or privacy practices of third-party providers.

We may make available a list of core Subprocessors upon request.

You agree not to:

• reverse engineer our systems
• attempt to bypass usage limits
• misuse APIs
• probe or disrupt infrastructure
• automate usage in a harmful or abusive manner
• use Spiel to build competing datasets or services
• violate rate limits or security controls

We may suspend or terminate accounts engaging in abuse or excessive usage.

Spiel does not guarantee:

• uninterrupted availability
• error-free operation
• that outputs will be unique or accurate

We may modify or discontinue features at any time.

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

Spiel disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
